Welcome to Kwena Design Agency. These terms of service outline the rules, obligations, and legal paradigms governing the deployment of our custom engineering and web layout production models.

1. Terms Definition

By accessing this platform or initializing a development project scope via our upfront packages (Startup or Growth models), we assume you accept these terms of service in full. Do not continue to utilize Kwena Design Agency's services if you do not agree to take all of the structural terms stated on this page.

2. Project Scoping & Payment Infrastructure

All technical web engineering tasks executed for local service entities across Pretoria & Gauteng are bound by the following contractual specifications:

  1. Upfront Estimates: Selected package criteria (R3,000 for Startup, R7,500 for Growth) represent flat-rate pricing metrics. Any custom API extensions or third-party calculations require independent quote generation.
  2. Revision Thresholds: Revision cycles are bounded explicitly by package definitions (1 round for Startup, 3 rounds for Growth). Iterations requested beyond these limits are subject to auxiliary billing.
  3. Delivery Timelines: Project milestones (7 days or 14 days) initiate strictly upon full delivery of text, images, and brand assets by the client.

3. Hosting Framework & Deployments

Kwena Design Agency deploys digital layouts utilizing secure, enterprise-grade Netlify infrastructure. While SSL provisioning and standard server runtimes are engineered for high-availability performance, the agency is not liable for structural third-party upstream platform downtime or auxiliary connectivity drops within the local Gauteng digital pipeline.

4. Intellectual Property Rights

Unless explicitly stated otherwise, Kwena Design Agency and/or its licensors own the intellectual property rights for all code frameworks, custom CSS code bases, and structural mockups generated during development. All intellectual property rights are reserved. Following final payment reconciliation, ownership of content-specific layouts transfers completely to the commissioning service entity.

5. Client Content Responsibilities

Commissioning business owners guarantee that all materials, copy text, imagery, and professional operational licenses provided to Kwena Design Agency for asset integration do not infringe upon third-party intellectual property laws. We reserve the right to remove or refuse to host any materials that violate local compliance regulations.

6. Limitation of Liability

In no event shall Kwena Design Agency be held liable for any secondary, consequential, or operational financial losses arising out of the performance or deployment of client web channels. We build high-performance, conversion-optimized landing environments, but cannot legally guarantee exact business revenue quotas or fixed lead conversion metrics.

7. Governing Law

Any legal claims or procedural disputes relating to Kwena Design Agency's production pipeline shall be governed and interpreted exclusively in accordance with the laws of South Africa.
